Family matter Mount Austin, Divorce Lawyer - Process after divorce (For Non-Muslim)

1) What are the types of documents that the client will get after divorce?
1. Decree Nisi;
2. Certificate of Decree Nisi Made Absolute; and
3. Letter of Update from Jabatan Pendaftaran Negara (JPN) about the registration of divorce.

2) What is the difference between Decree Nisi and Decree Nisi Made Absolute?
Decree Nisi will be issued first by the Court to show that the parties have met the requirement for divorce and this Decree Nisi will have the expiry date of (3) three months. Basically, this (3) three months period is being reserved for the party to discuss or rethink about the dissolution of the marriage either to cancel it or proceed before it become final. Therefore, a Decree Nisi cannot be considered as permanently divorced yet.
In order to make it as a final/permanent divorce, we need to make an application to the Court to make the Decree Nisi become Absolute provided that there is no party is against the application. Once the Certificate of Decree Nisi Made Absolute issued by the Court, only then the parties is to be considered as permanently/legally divorced.

3) When will the client get the Decree Nisi Made Absolute?
After the client sign the petition for divorce and other necessary documents, filing process will be made to the Court for the application. Later, the Court will issue the Hearing date that require both parties to come to the Court and usually, this will be the date that the Court granted the Decree Nisi if Court thinks fit.
If there is no party is against the Decree Nisi granted by the Court earlier, Decree Nisi Made Absolute will be applied at any time after the expiration of three months from the issuance of Decree Nisi by the Court. As a result, the Court will issue the sealed copy of Certificate of Decree Nisi Made Absolute for client’s safekeeping and the divorce will become legal.

4) What is the process of updating the Divorce status in Jabatan Pendaftaran Negara (JPN)?
After we receive the Certificate of Decree Nisi Made Absolute from the Court, we will send letter to JPN to update about the divorce for their registration process. Upon received our letter, JPN will issue another letter to inform us that the status of divorce is successfully been registered.

5) What are the documents required to be submitted to JPN to update their Divorce status?
1. Copy of Certificate of Decree Nisi Made Absolute;
2. Copy of Decree Nisi; and
3. Copy of marriage certificate.
6) When they can remarry after divorce?

The party can remarry after (3) three months of the issuance of Certificate of Decree Nisi Made Absolute from the Court.
