Joint Petition Divorce is defined as a married couple who mutually agree to divorce or dissolve their marriage and both are agreeable to the terms between themselves as well as agreeable to sign the petition in order to dissolve their marriage. It can also be called as a simplified uncontested divorce. Bear in mind that the requirement of joint petition is the couple must be married for at least or more than 2 years i.e from the date of registration of marriage. The date of registration can be referred from the certificate of marriage as below.

The general terms that usually couple may discuss are such as:-
(i) Arrangements of the assets such as property, car and etc;
One of the examples would be the arrangement of the joint property owned by both husband and wife. Parties should discuss who will continue serving the instalments if it is charged to the bank or who will buy over the half share of the other party or they can even discuss as to how they want to arrange their net profit after selling off the property.
(ii) Children’s custody/welfare;
Parties can discuss who will have the custody of children i.e whom the children will be staying with and the other party will have the right to visit the children. Parties can also discuss whether they want to set a certain time or schedule for the party to visit the children i.e on weekend/or certain days etc.
(iii) Maintenance of the children/wife/husband;
Parties can discuss for the monthly payment of the child’s/wife’s maintenance to be paid. However this is subject to the agreement between both husband and wife.
(iv) Arrangements of the insurance/medical/education of the children.
Parties may discuss who will bear the insurance/medical/education cost of the children such as either one party will bear or it could be borne by both parties or etc.
